ESFA as Guarantor of Academy Schools

The Education and Skills Funding Agency (ESFA) is the ultimate guarantor of academy schools.

In the light of this, The Scheme Advisory Board (SAB) has been asked to confirm its view that the ESFA is a body whose rights and/or liabilities under the scheme may be the subject of decisions made by the administering authority.

This is most likely to arise in connection with decisions relating to the exit of an academy school, e.g. whether exit payments or credits are due under regulation 64 of the LGPS Regulations 2013.

As the ESFA is a body whose rights and/or liabilities under the scheme may be the subject of decisions made by the administering authority, ESFA should be kept informed and is entitled to make representations as to its interests.
